Mapbox data editor terms and conditions - as of 23 September 2016

By clicking "I Agree", you agree to the following terms and conditions (the "Terms"), which form a binding agreement between you and Mapbox, Inc. ("Mapbox"). IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE MAPBOX'S DATASET EDITOR.

Authority. If you are using Mapbox's dataset editor on behalf of a business, that business accepts these terms. You represent that you have the authority to bind that business to these Terms, in which case "you" will mean the business you represent.

Tracing. You may use the Mapbox dataset editor or third-party software to trace Mapbox maps and produce derivative vector datasets (i) for non-commercial purposes and (ii) for OpenStreetMap. You may also use Mapbox's dataset editor to trace Mapbox maps for commercial purposes, but may only trace up to 100 points, lines, or polygons per year. Unless expressly permitted by your Enterprise Order, you may not otherwise trace Mapbox maps or otherwise derive or extract data from Mapbox maps, including satellite imagery, nor may you permit tracing of Mapbox maps or other data extraction from Mapbox maps. If you trace Mapbox Streets or Mapbox Terrain, you must comply with the applicable upstream licenses set forth on www.mapbox.com/about/maps/.

Dataset Geocodes - Restrictions. Points placed on a map through the places search function in the Studio dataset editor are "Dataset Geocodes". You may not use such Dataset Geocodes to: (a) to develop a general database of locations or addresses for any neighborhood, city, state, country, or other such geographic region, or to develop any other general purpose digital map database; (b) to develop or test another geocoding application or API; (c) in connection with navigation products preinstalled or integrated into automobiles by auto manufacturers, auto electronic component manufacturers or auto system integrators; or (d) for in-flight navigation. You may use Dataset Geocodes only for your own internal use. You may not resell, sublicense, or share Dataset Geocodes with any third party.

Dataset Geocodes - Supplier Rights. You acknowledge that the proprietary databases from which Dataset Geocodes are derived contain confidential information and that they are the result of substantial investment and protected by database rights as meant in European Database Directive 96/9/EC. Without limiting the foregoing, Mapbox and our suppliers will have the right to enforce such rights as contractual rights arising under this agreement. Upon notice to you, Mapbox or our suppliers may audit your use of Dataset Geocodes to ensure it is in compliance with these Dataset Geocodes paragraphs. These Dataset Geocode paragraphs are intended for the direct benefit of Mapbox’s third party geocoding suppliers and may also be enforced directly by those suppliers.

Dataset Geocodes - Country Restrictions. You may not use data of Norway to create general purpose printed or digital maps, which are similar to the basic national products of the Norwegian Mapping Authority.

Other Terms. These Terms hereby incorporate by reference any terms in the Enterprise Order between the parties regarding term, termination, renewal, dispute resolution, reservation of rights, prohibited uses of Mapbox services (as applicable to the dataset editor), limitations of liability, warranties, indemnification, assignment, legal notices, waiver, governing law or venue. If any such incorporated terms include a monetary amount or limitation (such as a limitation of liability up to a certain defined amount), then any amounts accrued under these Terms and the Enterprise Order toward such amount or limitation shall be summed to determine whether the monetary amount or limitation had been met under either agreement. Purely as an example and without limitation, if a party's total liablity under their Enterprise Order is limited to $50,000, the sum of such party's total liability under these Terms and such Enterprise Order will be limited to $50,000.
